Brenchleys Terms & Conditions

1. About Us
For the purpose of this document, Brenchley Supplies Ltd shall be known as the “supplier” and the “customer” shall be the person or persons placing the order.

Our policy is one of continuous improvement, we reserve the right to change specifications to our products or services without notice.

The property in the goods shall remain with Brenchley Supplies Ltd until such a time as the invoice and any other invoices to be paid by the customer are paid in full, but the risk in the goods passes to the customer on delivery.

All prices given on our website and literature are given in good faith and are in pound sterling. We reserve the right to refuse any order at our absolute discretion.

We do not supply any goods on a trial basis, the customer should always satisfy themselves as to the suitability of a product for their requirements before ordering.


2. Returns
Our return policies apply to goods unused and as new, in their original packaging (external & internal) and with all instruction manuals. Special order goods may not be returned unless found to be damaged or faulty upon delivery, un-damaged, un-used and in their original packaging with all instruction manuals included, you will be charged a 25% plus vat re-stocking fee for this.

The customer must arrange insurance with the carrier or forwarder when returning goods to cover possible damage or loss in transit for the full value of the item.

If we have to replace any lost manuals or packaging, the cost of this would also become payable by you the customer. You will be refunded or credited within 30 days for goods returned under the above terms.

Where applicable carriage or postal charges are not refunded in the event of a customer returning goods under our 7 or 30 day return policies.


3. Delivery
Free delivery applies to orders over *£199.00 plus vat to one UK mainland address. UK mainland excludes Northern Ireland, Isle of Man, Isle of Wight, Scottish Highlands, Islands and some areas of Scottish mainland.

All goods must be examined upon delivery for obvious signs of damage and a note must be made on the driver’s paperwork/electronic pad. If this is not possible you must add the words “un-checked” to your signature. The customer must inform Brenchley Supplies Ltd within 24 hours of receipt of any damage or shortage to their order.

A signature is required upon delivery for all goods.

You have the right to refuse delivery of a damaged item, please inform us immediately by telephone or email.

Carriers will make delivery to the door (or site) but not locations within unless agreed in writing prior to delivery.

Deliveries to addresses with a central receiving area will be delivered to that area. Goods are delivered to the receivers address but not necessarily to the named contact.

Should you fail to take delivery at the appointed address and time, goods may be returned to our warehouse or supplier. The costs incurred where goods are returned in relation to failed delivery attempts shall be passed on to you, the customer.

Claims for non delivery of goods must be made to us in writing within 7 days of the invoice date.

You must make sure that you have adequate provision and personnel to receive goods once off-loaded from the vehicle as the driver is under no further obligation from that point.

You must make sure that you have checked all dimensions thoroughly and have adequate access for the goods being delivered, particularly large and bulky items.

Brenchleys Ltd reserves the right to charge for failed deliveries.

Deliveries required at specific times during the day will be charged extra.


4. Installation
Installation is not included unless agreed in writing.

The customer agrees to indemnify Brenchley Supplies Ltd against claims for defects caused to equipment by faulty or inadequate installation.

All gas appliances must be installed by a Gas Safe registered engineer as required by law, and a certificate of installation should be made available to the supplier on request.

All electrical equipment must be installed by a suitably qualified engineer and a certificate of installation should be made available to the supplier on request.

Any equipment which is required to be connected to the mains water supply should be installed by a suitably qualified engineer and a certificate of installation should be made available to the supplier on request.

Water softeners must be installed according to the manufacturer’s recommendations or the products guarantee may be invalidated.


5. Guarantee
All goods supplied by us carry 12 months parts and labour guarantee unless different terms are stated in the product’s description on our website, in our literature or agreed in writing by us.

Where applicable, parts and labour guarantee only applies to UK mainland. Customers should be aware that a limited amount of heavy equipment carries parts only guarantee in Scotland.

Some manufacturers operate a “Back to Base” guarantee where the item must be returned to them for repair, in these cases we do not provide replacement or loan equipment. If the warranty terms are ‘Back to Base’ then it is the customers responsibility and at their expense to return it to the manufacturer.

Every effort will be made by us to handle service calls quickly, however the manufacturer will dictate the service arrangements. It may not be possible for service calls to be made on weekends, bank or public holidays, evenings or at a time the customer specifies.

If a service call is requested during the guarantee period and the fault lies with the operation or installation and not the equipment itself then the charge for the service call will be payable by the customer.

Any warranty cards must be returned to the manufacturer duly completed.

Brenchleys Ltd is not liable for any consequential loss or damage of any sort.

If any person undertakes the supply and/or fitting of parts not specified by the manufacturer, then any guarantee for that product may be void.

Wear and tear of a product is not covered by guarantee, nor is damage, misuse or lack of maintenance (including cleaning or descaling) where applicable.


6. Limitation of Liability
The Customer agrees that Brenchley Supplies Ltd shall not be liable for any losses or damage suffered by the Customer including but not limited to loss of business, business interruption or loss of time, due to the use or purchase of the Goods by the Customer.

Goods sold are not insured for delivery unless confirmed as insured by Brenchley Supplies Ltd on acceptance of the Order.


7. Intellectual Property Rights
The acceptance of a quotation includes the recognition by the customer of the right of the Company under any patent rights, trademarks, registered designs or other intellectual property rights relating to the goods, and the customer undertakes that patent numbers, trademarks or other trade markings on goods supplied shall not be obliterated, altered or defaced.

8. General
Should any of the conditions herein be in conflict with those of the buyer, these conditions shall prevail. These conditions and any contract entered into shall be subject to and construed in accordance with English law.

If the customer is dealing in the capacity of a consumer then these terms and conditions shall not affect their statutory rights

The price of goods for export/ overseas orders does not include transportation costs or import or export duty or documentation charges of any kind. The payment of which is the responsibility of the recipient of the goods.

Placing an order constitutes acceptance of the above Terms & Conditions.
